TERMS AND CONDITIONS OF SALES

QUOTATIONS & ACCEPTANCES: All proposals and acceptances of orders are made with the mutual understanding that orders are not subject to cancellation. The shipping date is approximate only and is conditional upon delays, nonperformance occasioned by strikes, fires, or other causes beyond our control. This agreement shall be a Idaho contract and shall be interpreted and administered for all purposes under the laws of Idaho.

WARRANTY: The manufactured parts covered are warranted to be free of defects in materials and workmanship under normal & proper usage owned by the original purchaser. CURLYRCWORLD LLC sole obligation under this warranty is limited to

NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NO IMPLIED WARRANTY, WHICH EXCEEDS BEYOND THE DESCRIPTION OF THE EQUIPMENT. CURLYSRCWORLD LLC SHALL NOT BE RESPONSIBLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES of this buyer connection herewith, such loss of production, loss anticipated savings or anticipated profits, or damages of-any third party asserted against the buyer. CURLYSRCWORLD LLC shall in no event and for no cause whatsoever, including any breach or default by CURLYSRCWORLD LLC have any monetary liability to the Buyer in excess of the contract price of the pertinent item or items of equipment.

TERMS: Cash with order, or stated terms. It is understood that there are no conditions or agreements outside of this written proposal and that all prior conversations, agreements or representations with reference to its subject matter are suspended. All Sales are subject to applicable federal, state, and local use, sales, and excise taxes which the purchaser agrees to pay, and which may be billed as part of the selling price, or separately, if the seller is required by any taxing authority to collect and pay such a tax. We reserve the right to correct stenographic errors.

INDEMNIFICATION: User agrees to indemnify and hold harmless and defend seller of and from any and all claims or liabilities from accidents involving this equipment caused by failure of users, his employees, or agents to follow instructions, warnings, or recommendations furnished by the manufacturer, or seller, or by failure of user to comply with federal, state, and local laws applicable to such equipment including the Occupational Safety and Health Act of 1970 as amended. User shall notify seller promptly of any accident involving this merchandise and any event within 30 days after occurrence, and shall cooperate fully with seller, or seller’s agent in investigating and determining the cause of said accident.         

All invoices are due in full upon receipt of goods & services

15% late fee may be applied on invoices 30 days past due
